Terms and conditions.

We wish to make our terms and conditions easily understandable. The terms written in this document affect all users, partners and lenders who make use of Mutuari Portugal. These terms also capture all services MUTUARI provides, including sales and distribution.

When you browse and use the MUTUARI website at www.mutuari.pt, you are agreeing to comply with and be bound by the following terms and conditions of use. MUTUARI PORTUGAL reserves the right to update, change or replace any part of these terms of service by posting updates and/or changes to our website without any further notice.

1. GENERAL INFORMATION

MUTUARI PORTUGAL provides accessory renting services in Portugal. 

In this agreement:

By “MUTUARI”, “we”, “us” or “our”, we refer to MUTUARI PORTUGAL.
By “customer” or “you” we refer to a person who uses any of our services.
By “Lender” we refer to a person who is renting out an item through our website, and has agreed to our Private Lender Agreement.
By “Partner” we refer to a company who rents out items through us. 

When we use the word “services” we are referring to the general services we provide to our customers. If relevant, said service will be specified.

2. RENT

If you rent one or more of our items it means that you pay a one time charge. The charge is determined based on the price of the item you are renting and the length of the rent period. We reserve the right to change the price of items at all times, however we will not charge nor refund the difference if the prices change during your rent period.

Four (4) days are always included in the rental cost, including cleaning services, shipping and return costs. We may agree upon a meeting place in Lisbon for delivering and returning the item(s).

Delivery and return shall be made via a mail service of our choice. In-person delivery and/or return is also available upon request and arrangement.

You can rent any item as long as it is available. You can rent an item up to 1 month consecutively as long as it is available for the whole selected period. 

If the item(s) arrives late or suffers damage during shipping for delivery, MUTUARI PORTUGAL will strive to compensate the customer. You can read more about this in section 5 - “Satisfaction Guarantee”.

Upon returning a rented item you will not be charged additionally for any “normal wear and tear”. You can read more about this under section 4 - “When the item is with you”.

3. RENTING TERMS

The length of the rent period is determined by the start and end date chosen by the customer during the booking process. On the item page on our website you can see in the calendar whether the item is available between your chosen dates. The calendar will show availability 6 months in advance. All items’ rent prices will include a minimum of four (4) days of rent. The start price will not change if you choose to rent for a shorter period. 

The rent period’s start date is the date the item(s) should be delivered to you. Sometimes delays or other obstacles may occur that prevent us from delivering by your start date but you should be contacted in advance if this is the case. If this happens to you, we will strive to find a solution that is satisfactory to you, for example by offering an alternative item or refund (partial or whole order). Be aware that delays from third parties may also occur. We therefore recommend you set your start date in good time before you will need / are planning to use the item(s).

For safety reasons, and to ensure your privacy, most items will be delivered to the closest postal office or pickup point, and not to your door. Some orders may still be delivered to your door if the value of the item(s) is not too high, and if your home is suited for this kind of delivery. 

You are obligated to return the item(s) on the end date of the rent period. Please see more details in section 6 - “Delivery and return”. 

4. WHEN THE ITEM IS WITH YOU

It is expected that any item is treated as if it was your own, and that it is returned in the same condition as when you received it. Cleaning is always included in the rental cost, so it will not be necessary to clean the item before you return it. 

You are solely responsible for any damages and stains that are not considered normal wear and tear by our team upon the item’s return. “Normal wear and tear” includes broken zippers, small removable stains, loose pearls/sequins, and other wear and tear we deem typical for use of the items. 

If the item is stained or damaged in a way that can not be washed/cleaned or repaired, this is not considered normal wear and tear. Stains from makeup and self tanner are not considered normal wear and tear. 

Should you be unfortunate enough to damage an item, and the item is still considered usable, we will charge you a fee based on the degree of the damage and the item’s value at the time of the renting period. This fee may be up to 2000 EUR. 

If a rented item is stolen, lost or damaged and not considered usable, you are fully responsible to compensate for the item. The compensation will be based on the original price for a new or similar item, plus an administration fee of 10% of this value. If the item is not returned within 14 days after the end date of your rent period, the item will be considered stolen and you will be charged the value of a new or similar item plus the administration fee of 10% of this value. 

5. SATISFACTION GUARANTEE

You will always have a 100% satisfaction guarantee when you rent from us. This guarantee covers delays or damages upon arrival to you. To use this guarantee you must contact us within 12 hours of the received order. We will do our best to find a solution that fits both parties.

6. DELIVERY AND RETURN 

All deliveries will be handled through CTT or UPS. Alternatively we may arrange an in person delivery inside the Lisbon Metropolitan area. 

You are responsible for providing the correct name and address when placing an order. If you input the wrong name or wrong address and that causes obstacles, mistakes or delays upon delivery, you will be held responsible for any potential loss, theft or damage of the item should it result from that delay or obstacle, and will be charged.

The item may be dispatched up to 10 days prior to the start date, and early delivery may therefore occur. When the package is delivered to the address you provided in the order, you are responsible to collect the package and ensure it is safe with you until the end of the renting period. If you are traveling or not at home during a period of 10 days before the rent start date, please inform us about this by sending an e-mail to mutuariportugal@gmail.com as soon as possible after placing your order.

If your item arrives after the rent start date, we are held responsible and will strive to find a solution that suits both of us. You can always utilize your satisfaction guarantee. 

If you do not return the item(s) on the rent period end date, you will be contacted and asked to provide a proof of return as soon as possible. We will charge a late fee corresponding to the rent price for each day the item(s) are delayed, plus a fee of 20 EUR per week. This fee will be charged when the item(s) are confirmed returned. 

You are obligated to return the item(s) with potential dust bags or other packaging that were included when you received your package.

If the item(s) are not returned within 14 days after the rent period end date, we will charge you the value of a new or similar item, plus a 10% administration fee. In this case we will consider the item(s) stolen and file a police report for theft.

Should you return the item at the end date of the rent period, and we do not receive it within 14 days, you will not be charged if you provide proof that you fulfilled your responsibility to return the item on the correct date, the correct way. 

7. DISCOUNTS

In some periods we may offer discount codes. These are digital codes you can use upon checkout. These codes may be limited to certain items or terms, for example that it is only available for new customers. 

 Discount codes can not be combined and are often active for a limited time only. 

8. CHANGES TO AN ORDER

Any changes to an order must be done a minimum of 10 days before the rent period start date. Please send an e-mail to mutuariportugal@gmail.com for any changes, including prolonging the rent period, cancellations or booking another item. 

If you wish to change items, you must pay the difference if the new item(s) have a higher price. If the new item(s) has a lower price you will be refunded the difference. 

If you wish to make changes to the renting period, for example prolong the period, you must pay the item’s rent price for the extra days. If you wish to shorten the period you will be refunded the difference. Please note that refunds for shortened periods only will occur if you inform us in advance of the period (minimum 10 days before the original start date). You will not receive a refund if you only return the items early without contacting us as described above. 

Please note that it can take up to 30 business days from the date the item(s) are confirmed returned, before you receive your refund. 

9. CANCELLING

If you wish to cancel your order, you must notify us minimum 10 days before the rent period start date. The charged amount will be returned to your account within 30 business days. Cancellations made less than 10 days before the start date cannot be refunded. However you can change the dates of the rent period, or item, given that the item(s) are available on the desired dates. If you choose to postpone the rent you cannot be refunded if you cancel the order at a later time. 

10. DEVIATION FROM PHOTOS

Sometimes our products may vary slightly in color and style from the pictures displayed on our website and social media. Small signs of use must be expected, and the item(s) may have been repaired. 

11. FORCE MAJEURE

Neither MUTUARI PORTUGAL, you or third party are held responsible for delays or damages if this is caused by an obstacle that is outside of the parties’ control.

12. LEGAL 

Disputes between the parties must be resolved through negotiations. If a solution is not reached, the case must be referred to ordinary court proceedings. The terms are subject to Portuguese law.
